PROVISIONS ON THE IMPORT OF LUBRICANTS

Attachment
Considering:
- a. that as a follow-up to Presidential Decree No. 21/2001 on the supply of lubricants, it is necessary to review and improve provisions on the import of lubricants;
- b. that for this purpose, it is necessary to issue a joint decree of the Minister of Energy and Mineral Resources, the Minister of Finance and the Minister of Industry and Trade;
In view of:
- 1. Law No. 5/1999 on anti monopoly and unsound business competition (Statute Book of 1999 No. 33, Supplement to Statute Book No. 3817);
- 2. Law No. 8/1999 on consumer's protection (Statute Book of 1999 No. 42, Supplement to Statute Book No. 3821);
- 3. Presidential Decree No. 165/2000 on the position, task, function, authority, organizational structure and working system of ministry, as has been amended by Presidential Decree No. 37/2001;
- 4. Presidential Decree No. 234/M/2000 on the formation of the Cabinet for the 1999-2004 period as has been several times amended the latest by Presidential Decree No. 177/M/2001;
- 5. Presidential Decree No. 21/2001 on the supply of lubricants;
- 6. Regulation of the Minister of Mines and Energy No. 0223K/43/M.PE/1991 on the control of quality of products of domestic oil and natural gas purification and processing;
- 7. Decree of the Minister of Industry and Trade No. 229/MPP/Kep/7/1997 on general provisions in the import sector;
- 8. Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to trade regulations as has been several times amended the latest by Decree of the Minister of Industry and Trade No. 192/MPP/Kep/9/2000;
- 9. Decree of the Minister of Mines and Energy No. 019K/34/M.PE/1998 on the obligation to register lubricants circulating in the domestic market;
- 10. Decree of the Minister of Mines and Energy No. 1748/34/M.PE/1999 on the obligation to register lubricants circulating in the domestic market;
- 11. Decree of the Minister of Mines and Energy No. 1693K/34/MEM/2001 dated June 22, 2001 on the manufacture of lubricants and the processing of used lubricants and the quality of lubricants.

JOINT DECREE OF THE MINISTER OF ENERGY AND MINERAL RESOURCES, THE MINISTER OF FINANCE AND THE MINISTER OF INDUSTRY AND TRADE ON PROVISIONS ON THE IMPORT OF LUBRICANTS
Article 1
(1) Raw materials for lubricants in the form of raw lubricants as referred to in Article 6 paragraph (2) of Presidential Decree No. 21/2001, classified as heading number 2710.00.910 can only be imported by the companies securing permits as producer/importers (IP) and are merely used for their production.
(2) The permits for producer/importers as referred to in paragraph (1) shall be issued by the minister responsible for the trade sector.
(3) Importers that do not strictly adhere to the provisions in paragraph (1) shall be liable to sanction within the frame work of the existing rules.
Article 2
(1) Lubricants with heading numbers 2710.00.920, 2710.00.930, 2710.00.950, 2710.00.990, 3403.11.100, 3403.11.900, 3403.19.000 and 3403.99.000 can be imported by the companies holding general importer's identification number (API-U).
(2) Detail of lubricants as referred to in paragraph (1) shall be as attached thereto.
(3) Import duty on lubricants that do not belong to the heading numbers as referred to in paragraph (1) shall be stipulated by the Minister responsible for the financial sector.
Article 3
(1) Lubricants as referred to in Article 2 paragraph (1) can only be imported and marketed on the domestic market provided that they have met quality standards (specifications) and bear lubricant registry number (NPT) in accordance with the provisions stipulated by the Minister responsible for the oil and natural gas sector.
(2) Importers or traders marketing lubricants that do not meet the requirements as referred to in paragraph (1) shall be liable to sanction within the framework of the existing rules.
Article 4
With the stipulation of this joint decree, joint decree of the Minister of Mines and Energy, The Minister of Finance and the Minister of trade No. 829K/004/M.PE/89, No. 836/KMK.001/1989 and No. 181/KPB/VII/89 on the import of lubricants shall be declared null and void.
Article 5
This joint decree shall begin to take effect on the date of stipulation
For public cognizance, this joint decree shall be announced by placing it in the State Gazette of the Republic of Indonesia.
